| Condominiums and
Planned Communities Sellers, Hinshaw, Ayers, Dortch &
Lyons, P.A. is widely recognized for its knowledge of the law
applicable to condominiums and planned communities and its
expertise in assisting the developers who create them and the
managers and association board members who administer them. For
more than two decades, our firm has been involved in the
development of the legislation and in the trial and appellate
court decisions that have shaped the law in this increasingly
complex area.
Our attorneys assist our developer clients in structuring the
communities they create to ensure that their vision becomes
reality. We take the time to thoroughly understand the plan and
purpose for each project, whether it be a relatively simple
single-family subdivision or a complex, mixed-use development.
We then thoughtfully and carefully prepare the legal documents
that address the particular needs and reflect the unique
character of the community. We are positioned to help with all
aspects of the formation process including land acquisition,
corporate organization, governmental approvals, permitting and
zoning.
After communities are in place, we advise the officers,
directors and managers who guide the associations responsible
for their ongoing administration. The firm currently represents
more than 500 condominium and planned community associations
across North Carolina and in upstate South Carolina. We provide
our association clients with counsel and direction on the
document interpretation, corporate administration, restriction
enforcement, architectural control and assessment collection
issues that arise on a day to day basis, most of which are well
beyond the experience and capabilities of the dedicated
volunteers who serve them. Our attorneys are also equipped to
help with bankruptcy cases, insurance questions, construction
defect claims, labor and employment matters, code violations,
fair housing concerns and litigation, as those needs arise from
time to time.
Because of our extensive experience in this multi-dimensional
area of the law, we can be of greater service if we are involved
in the process sooner rather than later. Frequently, we can help
association leaders see and avoid situations that are traps for
the unwary before they become expensive problems that are far
more difficult to resolve. Contact
